3. Placing an order and formation of the contract
The products shown in our shop are an invitation to place an order, not a binding offer. You can order as a guest or with a customer account.
- You add the products you want to your basket and go to the checkout.
- You enter your delivery details and choose the payment method. Before you submit your order, you can review all details and correct any input errors, for example by changing the entries or the basket contents.
- By submitting your order, you make a binding offer to buy the goods in your basket.
- We confirm receipt of your order by email. This email is not yet our acceptance of your offer. The contract is concluded when we accept your order, either by sending you a separate email confirming that the goods have been dispatched or by delivering the goods, whichever happens first.
If we cannot accept your order, for example because a product is no longer available, we will tell you without delay and refund any payment already made.
Please keep the order confirmation for your records. If you have a customer account, you can also see your orders there. Guests can look up their orders using their email address.
4. Prices and delivery costs
- All prices are shown in pounds sterling (GBP).
- The prices shown include VAT at the current rate of 20%.
- Parcel delivery within the United Kingdom is free of charge, so no delivery costs are added to the price of your order.
- The total price you pay is shown at the checkout before you submit your order.
If a price is obviously wrong, for example because of a clear technical or typing error, we may decline the order before the contract is concluded and refund any payment already made. This does not affect your statutory rights.
5. Payment
You can pay for your order by credit card. The payment methods available to you are shown at the checkout.
Payment is taken when you place your order. If a payment is declined or reversed without justification, we may withhold delivery or cancel the contract.
6. Delivery
We deliver only within the United Kingdom. The following delivery option is available:
Parcel delivery
- Free tracked parcel delivery to your door anywhere in the United Kingdom.
- Delivery cost: £0.00.
- Delivery time: 2 to 5 working days in total.
- Working days are Monday to Saturday. Sundays do not count.
The delivery time stated is the total delivery time. Please make sure your delivery address is complete and correct and that someone can receive the parcel.
If we fail to deliver within the agreed time, your statutory rights under section 28 of the Consumer Rights Act 2015 remain unaffected.
7. Your right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you generally have 14 days to cancel your order without giving a reason. We provide a prepaid return label, so returning goods by post is free of charge for you. Any refund is made no later than 14 days after we receive your notice of cancellation.
The full conditions, the deadlines and the procedure are set out in our Cancellation Policy.
8. Retention of title and risk
The goods remain our property until we have received full payment of the price.
The goods are at your risk once they have been delivered to you or to a person you have nominated to receive them. Until then, they are at our risk.
9. Statutory rights and liability for defects
We are liable for defects in the goods in accordance with the Consumer Rights Act 2015. Goods must be of satisfactory quality, fit for purpose, as described and as shown in any sample or model.
- For new goods, our liability for defects applies for 24 months.
- If goods do not conform to the contract, you may be entitled to a refund, a repair or replacement, or a price reduction, depending on the circumstances and the time that has passed.
- Nothing in these Terms and Conditions limits your statutory rights under the Consumer Rights Act 2015.
We do not offer our own commercial guarantee. Some products come with a manufacturer's guarantee. That guarantee is provided by the manufacturer, is separate from our liability and does not affect your statutory rights.
10. Our liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
Subject to this, we are liable for losses that are a foreseeable result of our breach of contract or our failure to use reasonable care and skill. We are not liable for losses that were not foreseeable when the contract was made.
11. Complaints and dispute resolution
If you have a complaint, please contact us first by email at support@enertechy.com or by telephone on +44 20 4577 3197. We will do our best to resolve the matter quickly and fairly.
We are not tied to a specific alternative dispute resolution (ADR) body. If we cannot resolve your complaint, you may refer the dispute to an ADR provider approved for your type of dispute. We will tell you whether we agree to take part in ADR with the provider you choose.
Your right to take legal action before the courts is not affected.
12. Personal data
How we process your personal data is explained in our Privacy Policy. Information about cookies and similar technologies is given in our Cookie Policy.
13. Governing law and jurisdiction
These Terms and Conditions and any contract between you and us are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also rely on the mandatory consumer protection rules of the country where you live and bring proceedings in the courts of that country.
The version of these Terms and Conditions in force at the time you place your order applies to your contract. Tech Outlet LTD, trading as Enertechy, may update these terms for future orders.
